Terms of Service

These Terms of Service are an agreement between you and N8tive Flow LLC, a Texas limited liability company ("we," "us," or "our"), for the AIlign app and related services. By creating an account or using AIlign, you agree to these terms. If you do not agree, do not use the service.

What AIlign is

AIlign is a daily companion app built around an AI conversation. You talk to AIlign, AIlign gets to know you, and that knowledge powers a daily planner inside the app. AIlign isn't a person. It's software running on top of Anthropic's Claude API to generate responses.

Who can use it

You must be at least 13 years old and meet any higher minimum age required where you live. If you are under 18 or the age of legal majority where you live, you must have a parent or guardian's permission and supervision. A parent or guardian who permits use is responsible for reviewing these terms. Do not misrepresent your age. Health and fitness features are not a substitute for age-appropriate professional guidance.

Your account

Use a real password and don't share your login. If you think someone else got in, email n8tiveflowai@gmail.com and we'll help you lock things down. You are responsible for keeping your login secure and for activity you authorize. Tell us promptly about suspected unauthorized access.

AIlign Pro and payments

AIlign offers free features, which may have usage limits. AIlign Pro is an optional paid subscription that unlocks the full AI experience. It's sold as an auto-renewing subscription through your Apple App Store account, and here's how that works:

• The price and billing period (monthly or yearly) are shown in the app before you buy. Payment is charged to your Apple ID when you confirm the purchase.
• Your subscription renews automatically at the end of each period, and your Apple ID is charged within 24 hours before it renews, unless you turn off auto-renew at least 24 hours before the period ends.
• You manage or cancel a subscription in your Apple ID account settings, not inside AIlign. Deleting the app on its own does not cancel it.
• Pro is sometimes offered with a free trial or an introductory price. Unless you turn off auto-renew at least 24 hours before the free or discounted period ends, it converts automatically into a paid subscription at the standard price, charged to your Apple ID. Any unused part of a free period is forfeited if you subscribe to a paid plan before it runs out.
• Refunds are handled by Apple under the App Store's terms. We generally can't refund App Store purchases directly.
• We may change what Pro costs or what it includes. If a change affects a subscription you already have, we'll give you notice, and it won't take effect until your next renewal, when you can decide whether to keep going.

Offer codes

We sometimes hand out offer codes that unlock a stretch of Pro, usually two weeks, at no charge. A few rules:

• Codes are redeemed through your Apple ID and are subject to Apple's terms as well as these.
• Unless you cancel at least 24 hours before the free stretch ends, the subscription renews automatically at the standard price.
• Eligibility, redemption limits, expiration and whether offers can be combined are shown with the offer and controlled by Apple's applicable terms.
• Codes have no cash value, cannot be sold or transferred, and we can withdraw or expire a code at any time.

Inviting friends

AIlign has an invite program: share your link, and when someone you invited subscribes, you get free Pro. The terms of it:

• You get 14 days of Pro for each person who starts a paid subscription through your link. A free trial or a redeemed offer code does not earn a reward until it converts to a paid subscription.
• Rewards stack, so two paid conversions are 28 days.
• You cannot invite yourself, and an invite used on your own account, or on accounts made to work around that, does not count.
• A reward already granted is not taken back if the person you invited later cancels or refunds.
• Rewards are free Pro time only. They have no cash value and cannot be transferred or exchanged.
• We can change the reward, the rules, or the whole program, and we can end it. Anything you have already earned stays yours.
• Spamming your link, or presenting it as something other than an invite to AIlign, ends your access to the program.

What AIlign is not

AIlign is not a doctor, a therapist, a lawyer, or a financial advisor. The things AIlign says might be helpful. They might also be wrong. Sometimes both at once.

AIlign also estimates things like calorie targets, nutrition, weight trends, and activity from what you and your connected devices tell it. Those are rough estimates meant to help you reflect, not individualized advice from a qualified medical, nutrition, or fitness professional, and they shouldn't be treated as exact.

AIlign can also look things up on the web and will show you the pages it used. Those pages are other people's, we don't control them and we don't vouch for them, and an answer built from them can still be out of date or wrong. Check anything that matters at the source.

Health, fitness, and exercise risks

Workout plans and suggestions are AI-generated from limited information you provide. They are not a professional assessment of your health, technique, equipment, or ability. Exercise can cause injury, illness, or other serious harm. Consult a qualified healthcare professional before starting or changing exercise or nutrition, particularly if you have an injury, medical condition, symptoms, are pregnant or postpartum, or have been inactive.

Choose movements, loads, duration, and intensity appropriate for you and your environment. Check equipment and get qualified instruction when needed. Do not continue through pain. Stop and seek appropriate medical help if you develop concerning symptoms, including chest pain, fainting, severe shortness of breath, or sharp pain. To the extent permitted by law, you voluntarily assume the ordinary risks of exercise you choose to perform. This does not waive liability or rights that cannot legally be waived.

BMI, calorie and nutrition estimates, weight trends, health scores, sleep scores, and activity insights are general wellness estimates. A health score is not a clinical assessment; a sleep score may reflect duration rather than sleep quality. BMI does not measure body fat or diagnose health. In the current app, BMI and automated personalized nutrition targets require an age of at least 20; that does not make the other health features medically appropriate for everyone. Device readings and manual entries may be missing or inaccurate. Do not use AIlign to pursue unsafe restriction, rapid weight loss, or exercise against professional advice.

Your workout plan and booked classes

You can record plans, gym or equipment preferences, sets, repetitions, loads, times, distances, and classes you have arranged elsewhere. AIlign's fitness calendar is a planning and tracking tool. Adding a class does not reserve a place, pay a gym, contact a trainer, or confirm attendance. AIlign cannot verify a gym's equipment or a class's availability.

A flexible workout sequence can bring forward your next unfinished session when you miss a day. A morning routine can refer to that plan or a dated class. These features do not guarantee a calendar entry or reminder, and a planned or completed label is not independent evidence that an activity occurred. Review and correct AI-created plans, schedules, and recorded results.

What you agree not to do

• Use AIlign to break the law or hurt anyone
• Try to get AIlign to produce content sexualizing minors, or anything else illegal
• Scrape, reverse-engineer, or rebuild the app
• Share someone else's private information with AIlign without their permission
• Use AIlign to spam, harass, or impersonate other people

Your stuff stays your stuff

The things you share with AIlign, like your conversations and your onboarding answers, belong to you. We don't claim ownership. You grant us a limited permission to host, process, and transmit your content to provide and secure AIlign, including using the service providers described in our Privacy Policy. This permission does not give us ownership of your content or replace any separate consent required for sensitive data or third-party AI sharing. You must have the right to share what you submit. The privacy policy lays out exactly how that works.

Our stuff stays our stuff

The AIlign app, its name, its design, and its code are all ours. We grant you a limited, personal, non-transferable license to use the app on Apple-branded devices you own or control, subject to the App Store Usage Rules and any applicable Family Sharing or volume-purchasing rights. You may not copy or resell our software or branding, except as permitted by law. These restrictions do not limit rights under applicable open-source licenses or rights that cannot legally be restricted.

Things change

AIlign is being actively built. Features get added. The interface shifts. Sometimes the AI underneath gets swapped or upgraded. We're not promising the app stays the same forever.

We might shut it down

If we discontinue AIlign, we will provide notice and a reasonable opportunity to request a copy or deletion of your information where practical and as required by law. Subscription rights remain subject to applicable law and App Store terms.

We might end your access

If you break these terms, especially the part about harmful use, we can suspend or close your account.

No promises about perfection

AIlign is provided as-is. There will be bugs. There will be downtime. Sometimes AIlign will say something weird or wrong. We don't guarantee the app is always available or always correct.

Limits

To the extent the law allows, AIlign is provided without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. No exclusion or limitation in these terms applies to fraud, willful misconduct, gross negligence, or any other liability that applicable law does not allow us to exclude or limit. N8tive Flow LLC and AIlign aren't liable for any indirect, incidental, special, or consequential losses, or for lost data, that come from using the app. If a court ever decides we do owe you something, the most we'd owe, in total, is the greater of the amount you paid us for AIlign in the twelve months before the claim, or twenty US dollars. Some places don't allow these kinds of limits, so parts of this may not apply to you.

Changes to these terms

We may update these terms and will change the date above. For material changes, we will provide notice through the app, email, or another appropriate channel before the changes take effect, as required by law. Changes will apply prospectively. Where agreement or consent is required, posting a revision alone does not replace it.

About the App Store

You get AIlign through Apple's App Store, and a few things follow from that. These terms are between you and N8tive Flow LLC, not Apple. Apple isn't responsible for AIlign or its content, and has no obligation to provide support or maintenance for it. If AIlign fails to conform to any legal warranty and you're eligible, Apple may refund the purchase price to you, and to the maximum extent allowed by law that's the extent of Apple's warranty obligation. Any other claims, losses, liabilities, or costs tied to AIlign, including product liability, legal or regulatory compliance, and consumer protection claims, are our responsibility and not Apple's. If a third party claims AIlign infringes their rights, we, not Apple, are responsible for investigating and resolving that claim. You confirm you're not located in a country subject to a US Government embargo and that you're not on any US Government prohibited-parties list. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

The fine print

• If any part of these terms is found unenforceable, that part is trimmed to the extent needed and the rest stays in force.
• These terms, together with the privacy policy, are the entire agreement between you and us about AIlign, and they replace anything discussed earlier.
• If we don't enforce a rule right away, that isn't us giving it up, and we can still enforce it later.
• You can't transfer your rights under these terms to anyone else. We can transfer ours if AIlign is sold, merged, or reorganized.

Governing law

These terms are governed by the laws of the United States and, where applicable, the State of Texas, without regard to conflict-of-laws rules. Disputes may be brought in courts with proper jurisdiction in Texas, subject to any mandatory consumer rights or right to bring a claim in your home jurisdiction. These terms do not require arbitration or waive your right to bring a class action.
